KACC TAKES KEMSA CHIEF EXECUTIVE AND PROCURMENT OFFICER TO COURT
The Kenya Anti-Corruption Commission will be taking to the Nairobi anti-corruption courts the Kenya Medical Supplies Agency, KEMSA Chief Executive Officer, Mr. Charles Kandie and the Procurement Officer, Mr. Edward Buluma to face charges of failure to comply with the law relating to procurement by failing to appoint an evaluation committee to undertake the financial evaluation for the procurement of non-pharmaceutical products as required by Regulation 16 of the Public Procurement and Disposal Regulations, 2006. The KEMSA Technical Evaluation Committee which consisting of Dorcas Kwayera, Mercy Kasina, George Walukana, Mildred Sheishia and Jackson Mwangi will also be taken to court to face charges of using their office to improperly confer a benefit on Harleys Limited for the supply of eleven of the items tendered notwithstanding the fact that the manufacturers authorization letters did not comply with the tender specifications. They will be charged with abuse of office contrary to Section 46 as Read with Section 48(1) of the Anti-Corruption and Economic Crimes Act, 2003.
KACC will also be seeking from the court warrants of arrest since some of the suspects have since disappeared.
They will be taken to the Nairobi anti-corruption court, court no.1 today 18th February 2009 at 9am
