Commission wins major case towards recovery of Kenya Railways land in Kisumu valued at approximately KES.35 million

The Ethics and Anti-Corruption Commission (EACC) has won a major case towards recovery of Kenya Railways land in Kisumu valued at approximately Kshs.  35 million.

In the landmark case, EACC secured a favourable judgment against the two defendants Peter Okongo Oyoo and Sammy Komen Mwaita who appeared before the Hon. Justice S. M. Kibunja, Judge seating at the Environment & Land Court in Kisumu in the matter ELC No 731 of 2015

EACC had sought an order to declare the issuance of a lease by one of the defendants over Kisumu Municipality/Block 7/542 (measuring 0.0345 Ha null and void.

The Commission also sought an order for a permanent injunction against the Defendant, his agents, servants or representatives restraining them from leasing, transferring, charging, entering upon, developing, or in any other manner howsoever dealing with railways land.

EACC also sought a further order for cancellation of the lease over Kisumu Municipality/Block 7/542 and Certificate of Lease issued to one of the Defendants so as to restore the land to the Corporation.

In the meantime, EACC is seeking valuation of the property and that it be registered and the lands’ register is rectified as ordered by the Court.
