STAKEHOLDER ENGAGEMENT IN THE DEVELOPMENT OF GUIDELINES FOR CORRUPTION RISK ASSESSMENT AND MANAGEMENT

The Ethics and Anti-Corruption Commission (EACC) is a statutory body established under Section 3 of the Ethics and Anti-Corruption Commission (EACC) Act, 2011 pursuant to Article 79 of the Constitution. The mandate of the Commission is to investigate cases of corruption, economic crimes and ethical breaches; trace and recover corruptly acquired assets; prevent the occurrence of corruption; educate the public on the dangers of corruption; and promote ethics, leadership and integrity in the public and private sectors and the society in general, as stipulated in Section 11 of the EACC Act No. 22 of 2011.

Pursuant to its preventive mandate, the Commission advises and trains public officers and creates awareness among the public on matters relating to the prevention of corruption and unethical practices. It also undertakes system reviews in Ministries, Departments, Agencies and Counties (MDACs) as part of a strategy to monitor the practices and procedures of public bodies to detect corrupt practices and secure revision of methods of work or procedures that may be conducive to corrupt practices. 

Section 9 (1) of the Anti-Bribery Act No.19 of 2023 requires every public and private entity to put in place procedures appropriate to the size, scale, and nature of its operations to prevent bribery and corruption. When developing the procedures, the entities are further required to assess and map out bribery and corruption risks and develop a plan to mitigate the risks. 

In fulfilment of its responsibility under Section 9(3) of the Anti-Bribery Act to assist public entities, private entities, and any interested person in complying with the law, the Commission has developed Draft Guidelines for Corruption Risk Assessment and Management.
